The following Tru-D Warranty Terms and Conditions covers all devices from Tru-D SmartUVC, LLC, a Delaware corporation with an office located at 743 S. Dudley Street, Memphis, TN 38104

  1. Definitions.
    Device(s). Tru-D Classic, Tru-D iQ System, Tru-D iQ Tower, Tru-D iQ Scout and Tru-D iQ Controller.
  2. Limited Warranty. For a period of one (1) year after the purchase of a Device (the “Warranty Period”), Tru-D warrants the Device(s) subject to executed contract to be free from defects in material and workmanship under normal use when used in accordance with its operations manuals and labeling. If during the Warranty Period, the purchaser determines that a Device received from Tru-D is not operating as prescribed in such Device’s operations manual or is otherwise deemed defective, purchaser shall notify Tru-D of such Device defect by contacting the Tru-D Support Center as provided in Section 4 below. Purchaser’s sole remedy and Tru-D’s sole obligation with respect to any breach of this limited warranty shall be limited to the service options listed in Section 4.
  3. Limitations of Liability. Any Device that has been subjected to abuse, misuse, neglect, negligence, accident, improper testing, improper installation, improper storage, improper handling, abnormal physical stress, abnormal environmental conditions or use contrary to any instructions issued by Tru-D renders the warranty in Section 2 void. Further, the warranty is void if: i) at any time, purchaser, its agents, or employees attempt to make any alterations, repairs, or internal changes to any of the components of any Device not in accordance with any written service procedures or other instructions received from Tru-D; ii) at any time the power supplied to any part of any Device exceeds its rated tolerance; iii) any external device attached to any Device by purchaser, agents, or employees creates conditions exceeding the tolerance of such Devices; iv) the serial number plate for such Device is removed or defaced; v) any Device has not been operated in accordance with Tru-D’s furnished manuals; vi) Any Device has been used with any third-party products, hardware or product that has not been previously approved in writing by Tru-D; or vii) any Device has failed as a result of purchaser-supplied materials or components. OPERATION OF ANY DEVICE IN ANY MANNER THAT RENDERS THE WARRANTY IN SECTION 2 VOID WILL BE DEFINED TO INCLUDE ALL OF THE POSSIBILITIES DESCRIBED IN THIS PARAGRAPH, TOGETHER WITH ANY PRACTICE WHICH RESULTS IN CONDITIONS EXCEEDING THE DESIGN TOLERANCE OF SUCH DEVICE.
  4. Support Services. If any Device is determined to be non-conforming during the Warranty Period, purchaser shall report such non-conformity to Tru-D in accordance with the provisions below, wherein Tru-D, in its sole discretion, shall determine how to address the appropriate remedy.

    2. Upon purchaser contact, Tru-D will determine which of the following steps is appropriate for such non-conforming Device:
      1. on-site repair by Tru-D personnel;
      2. repair at a Tru-D repair facility;
      3. on-site repair by purchaser personnel (as trained by Tru-D) pursuant to instructions received from Tru-D, wherein Tru-D shall provide any replacement parts necessary to repair the non-conforming Device; or
      4. Such nonconformity constitutes a non-warranty repair. A non-warranty repair is any repair not covered under the limited warranty of Section 2 of this Agreement. Tru-D will quote the cost of the non-warranty repair for the Devices based on the information communicated by the purchaser at the time service is requested.
    3. Tru-D shall determine the appropriate service remedy for any nonconforming Device in its sole discretion. If requested by Tru-D, purchaser shall return such nonconforming Devices to Tru-D, in accordance with Tru-D’s instructions and the freight carrier arranged by Tru-D. Tru-D shall be solely responsible for the costs incurred in connection with the return of any such nonconforming Device or part thereof, including, but not limited to, freight and related insurance.
    4. If Tru-D receives any Device or part, which after a reasonable investigation cannot be shown to be defective, purchaser shall reimburse Tru-D for any shipping costs it has incurred. In addition, purchaser shall reimburse Tru-D and costs necessary to ship any Device or part related thereto from Tru-D to purchaser, including, but not limited to, freight and related insurance, wherein purchaser shall pay all such costs within thirty (30) days receipt of an invoice from Tru-D. If Tru-D determines that a returned Device or any part thereof is defective, and Tru-D repairs or replaces each Device or part returned to it, then Tru-D shall be solely responsible for all shipping expenses in connection with the return of such defective Devices or parts to purchaser.
    5. For any Device nonconformity reported to Tru-D (each, a “Report”):
      1. Within 24 hours after a Report, Tru-D will contact purchaser and provide a plan to resolve such Device’s nonconformity;
      2. Within 48 hours after a Report, Tru-D will have an on-site visit scheduled if required, and any Device capable of phone repair (each, as determined by Tru-D in its sole discretion) will be fully operational; and
      3. For any non-conforming Device requiring factory service by Tru-D (as solely determined by Tru-D), Tru-D shall ship or have shipped a temporary loaner device to purchaser and shall notify purchaser of the estimated arrival date of such loaner device.
